You may initiate the Services via telephone, via the Site, or other means made available by Ground Wire Computers . Ground Wire Computer will use commercially reasonable efforts to answer Your technology question and resolve Your technology problem for a fee as set forth in the Site or as quoted on the telephone, as applicable. Ground Wire Computers may provide certain portions of the Services via remote control session, online chat or e-mail. We may set forth limits to the technology We support. Certain Services may have minimum system requirements.
Ground Wire Computers. may include Services that are available on a one-time basis, for a fee (" Break / FIX"); as well as Managed Services, which are an entitlement to more than one Service over a period of time, for a recurring fee ("Managed Services")
You acknowledge that by Your use of the Services You are authorizing Ground Wire Computers to access and control Your computer or device (collectively "Device") for the purposes of diagnosis, service and repair.
In connection with delivering the Services, Ground Wire Computers may download and use software, gather system data, take remote control of Your Device and access or modify Your Device settings. By accepting these Terms, You hereby grant Ground Wire Computers the right to connect to Your Device, download and use software on Your Device to gather system data, repair Your Device, take remote control of Your Device and change the settings on Your Device while performing the Services. Other than as set forth in the warranty section below, You agree that Ground Wire Computers has no responsibility or liability under any circumstance at any time for any loss or harm that may arise from or may be related to the Services.
We may, but have no obligation to, monitor and/or to review all materials posted to the Site or through the Site's services or features by third parties, and We are not responsible for any such materials posted by third parties. We are not responsible for any failure to monitor, review and/or delete any materials posted to the Site or through the Site's services or features by third parties. However, We reserve the right at all times to disclose any information as necessary or advisable to satisfy any law, regulation or government request; and to edit, to refuse to post or to remove any information or materials, in whole or in part, that, in Our sole discretion, are in violation of these Terms or applicable law. We may also impose limits on certain features of the Site or restrict Your access to part or all of the Site without notice or penalty if We believe You are in breach of the guidelines set forth in Our Terms or in violation of applicable law without notice or liability.

NOR GROUND WIRE COMPUTER DOES NOT STORED YOUR DATA ON OUR STORAGE DRIVES WITHOUT YOU PERMISSION. ANY DATA STORED WHILE DOING THE SERVICES ARE BEING DELETED OR FORMATED UNPON VISITING THE OTHER CUSTOMERS.
The Services may not be successful because the problem may be beyond Our ability to resolve remotely. If You have purchased an Individual Service from Ground Wire Computers , then the following warranty applies: if We are not able to answer Your question or resolve Your technology problem and You have complied with all of Your obligations in these Terms, We will not charge You a fee for the Individual Service. If You experience a problem with the resolution We provided and You call Us within three (3) days from the day You originally received the Individual Service, We will use commercially reasonable efforts to try to resolve Your problem at no additional charge NO FIX NO FEE If those efforts are unsuccessful, We will refund the fees that You paid for the Individual Service. Or we do not charge for No FIX NO FEE Policy .
As set forth below, there are no other warranties for the Services.
Ground Wire Computers makes no warranties or representations with respect to advice, guidance, information or other content posted to the Community portion of the Site or otherwise supplied to the Site by any third party, and expressly disclaims all warranties, express or implied, with respect to Community content and other third party content available on the Site.
Ground Wire Computers does not guarantee that the operation of this product will be uninterrupted or error-free. Ground Wire Computers is not responsible for damage that occurs as a result of your failure to follow the instructions intended for the Ground Wire Computers hardware product and Service.
This Limited Warranty does not apply to expendable or consumable parts and does not extend to any product from which:
The serial number has been removed, damaged or rendered defective;
(a) as a result of accident, misuse, abuse, contamination, improper or inadequate maintenance or calibration or other external causes;
(b) by operation outside the usage parameters stated in the user documentation that shipped with the product(including burned monitor screens and incorrect input voltage);
(c) by software, interfacing, parts or supplies not supplied by Ground Wire Computers
(d) improper site preparation or maintenance
(e) virus infection
(f) loss or damage in transit
(g) by modification or service by anyone other than
(i) Ground Wire Computers
(ii) an Ground Wire Computers authorized service provider or Partner, Technician
(iii) your own installation of end-user replaceable Ground Wire Computers or Ground Wire Computers approved parts if
available for your product in the servicing country or region.
Ground Wire Computers IS NOT RESPONSIBLE FOR DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA. Ground Wire Computers IS NOT RESPONSIBLE FOR THE RESTORATION OR REINSTALLATION OF ANY PROGRAMS OR DATA OTHER THAN SOFTWARE INSTALLED BY Ground Wire Computer WHEN THE PRODUCT IS MANUFACTURED, or FOR END SALE .
Before returning any unit for service, be sure to back up data and remove any confidential, proprietary, or personal information..
Ground Wire Computers is not responsible for any interoperability or compatibility issues that may arise when (1) products, software, or options not supported by Ground Wire Computers are used; (2) configurations not supported by Ground Wire Computers are used; (3) parts intended for one system are installed in another system of different make or model
You must cooperate with Ground Wire Computers and promptly respond to Our requests for information and comply with Our requests to take actions to resolve Your technology problem. In order to help resolve Your technology issue, You may be required to consent to the downloading and use of Software on Your Device and accept all applicable license agreements for the Software and terms of trade agreement.
To enable Ground Wire Computers to provide the best possible support and service during the Limited Warranty, and IT support Period, you will be required to:
Maintain a proper and adequate environment, and use the Ground Wire Computers Hardware Product in accordance with the instructions furnished.
Verify configurations, load most recent firmware, install software patches, and implement temporary procedures or workaround provided by Ground Wire Computers while Ground Wire Computers works on permanent solutions.
Allow Ground Wire Computers to keep resident on your systems or sites certain system and network diagnosis and maintenance tools to facilitate the performance of warranty support (collectively referred to as Ă˘â‚¬proprietary Service Toolsâ‚¬Âť); Proprietary Service Tools are and remain the sole and exclusive property of Ground Wire Computers. Additionally, you will:
• Use the Proprietary Service Tools only during the applicable warranty period and only as allowed by Ground Wire Computers
• Install, maintain, and support Proprietary Service Tools, including any required updates and patches
• Provide remote connectivity through an Ground Wire Computers IT Support , if required
• Assist Ground Wire Computers in running the Proprietary Service Tools
• Use the electronic data transfer capability to inform Ground Wire Computers of events identified by the software
• Purchase Ground Wire Computers-specified remote connection hardware for systems with remote diagnosis service, if required
• Return the Proprietary Service Tools or allow Ground Wire Computers to remove these Proprietary Service Tools upon termination of warranty support
• Not sell, transfer, assign, pledge, or in any way encumber or convey the Proprietary Service Tools
In some cases, Ground Wire Computers may require additional software such as drivers and agents to be loaded on your system in order to take advantage of these support solutions and capabilities.
• Use Ground Wire Computers remote support solutions where applicable.
• Ground Wire Computers strongly encourages you to use available support technologies provided by Ground Wire Computers.
• If you choose not to deploy available remote support capabilities, you may incur additional costs due to increased IT support resource requirements.
Cooperate with Ground Wire Computers in attempting to resolve the problem over the telephone, Chat Session and e-mail . This may involve performing routine diagnostic procedures, installing additional software updates or patches, removing third-party options, and/or substituting options.
Make periodic backup copies of your files, data, or programs stored on your hard drive or other storage devices as a precaution against possible failures, alteration, or loss. Before returning any Ground Wire Computers Hardware Product for warranty support, back up your files, data, and programs, and remove any confidential, proprietary, or personal information.
Maintain a procedure to reconstruct your lost or altered files, data, or programs that is not dependent on the Ground Wire Computers Hardware Product under warranty support.
Notify Ground Wire Computers if you use Ground Wire Computers Hardware Products in an environment that poses a potential health or safety hazard to Ground Wire Computers employees or subcontractors. Ground Wire Computers may require you to maintain such products under Ground Wire Computers supervision and may postpone warranty service until you remedy such hazards.
Perform additional tasks as defined within each type of warranty service listed below and any other actions that Ground Wire Computers may reasonably request in order to best perform the warranty support.
Pick up and return, warranty and service
Your Ground Wire Computers Limited Warranty may include a pick up and return warranty service. Under the terms of pick up and return service, Ground Wire Computers will pick up the defective unit from your location, repair it, and return it to your location. Ground Wire Computers will incur all repair, logistics, and insurance costs for this type of service. This service also applies to your IT support Service if you are with Ground Wire Computers Managed Support service .
Mail-in warranty service
Your Ground Wire Computers Limited Warranty may include a mail-in warranty service. Under the terms of mail-in service, you will be required to ship your Ground Wire Computers Hardware Product to an authorized service location for warranty repair. You must prepay any shipping charges, taxes, or duties associated with transportation of the product to the repair location. In addition, you are responsible for insuring any product you ship, and you assume risk of loss during shipping. Ground Wire Computers will return the repaired product to you and incur all logistics and insurance costs to return the product to you.
Carry-in warranty service
Your Ground Wire Computers Limited Warranty may include a carry-in warranty service. Under the terms of carry-in service, you will be required to deliver your Ground Wire Computers Hardware Product to an authorized service location for warranty repair. You must prepay any shipping charges, taxes, or duties associated with transportation of the product to and from the service location. In addition, you are responsible for insuring any product shipped or returned to an authorized service location, and you assume risk of loss during shipping. Also if you are on Ground Wire Computers Route of service delivery we will drop your hardware to you and do a site installation of machine.
On-site, warranty , service
Your Ground Wire Computers Limited Warranty may include an on-site warranty service. Under the terms of on-site service, Ground Wire Computers may, at its sole discretion, determine if a defect can be repaired:
• By the use of a Customer replacement Parts
• By a service call at the location of the defective unit
If Ground Wire Computers ultimately determines that an on-site service call is required to repair a defect Or support Service , the call will be scheduled during standard office hours unless otherwise stated for the Ground Wire Computers Hardware Product or IT support you purchased. Standard office hours are typically 08:00 to 17:00, Monday through Friday, but may vary with local business practices. If the location of the defective unit is outside the customary service zone (typically 50km), response times may be longer or there may be additional charges. A next Business Day Service will be authorized by us for On site work.
Ground Wire computers ,also support the installation and setup of the hardware purchased from us . Software installation will be done , it excludes advance software configuration. Your Must Purchase Ground Wire Computers IT support Service.
Mission Critical IT Support ( Emergency , Urgent )
Ground Wire aims to ensure that a customer problem will be responded to within 2- 3 hours, following the end users first notification of equipment failure. Unless otherwise stated, all responses are measured from the time the customer calls, or a mutually acceptable time for support to be performed has been established, or Ground Wire has begun to provide support or remote diagnostics or On site . This is available on a 24 hour x 7 day basis with a work through until resolution of the problem. Applies to Break Fix Customer with Additional Call out this Service , and Managed Services Customers has a the option to select or included in the IT support Plan.
On site Same Business, IT Support, Hardware , Day:
Ground Wire aims to ensure that a customer problem will be responded to within 4 hours, following the end users first notification of equipment failure. Unless otherwise stated, all responses are measured from the time the customer calls, or a mutually acceptable time for support to be performed has been established, or Ground Wire has begun to provide support or remote diagnostics. This is available on a 24 hour x 7 day basis with a work through until resolution of the problem.
On site Next Business, IT Support, Hardware , One Day:
Ground Wire aims to ensure that the product will be operational by the end of the next business day following the end users first notification of equipment failure. Unless otherwise stated, all responses are measured from the time the customer calls, or a mutually acceptable time for support to be performed has been established, or Ground Wire has begun to provide support or remote diagnostics.
For example: Customer reports the failure of a Systems product at any time during business hours on Monday, the product will be fixed by the end of business day on Tuesday.
On site Two Business, IT Support, Hardware , Day:
Ground Wire aims to ensure that the product will be operational by the end of the second business day following the end users first notification of equipment failure. Unless otherwise stated, all responses are measured from the time the customer calls, or a mutually acceptable time for support to be performed has been established, or HP has begun to provide support or remote diagnostics.
For example: Customer reports the failure of a Business Desktop product at any time during business hours on Monday, the product will be fixed by the end of business day on Wednesday.
Ground Wire aims to ensure that the product will be operational and available to the end user within two business days following arrival of the faulty equipment at the service providers workshop location.
For example: Customer delivers a faulty product to a carry-in repair centre at any time during business hours on Monday, the product will be available for collection by the end of business day on Wednesday.
Carry-in Five, IT Support, Hardware , Business Day:
Ground Wire aims to ensure that the product will be operational and available to the end user within five business days following arrival of the faulty equipment at the service providers workshop location.
For example: Customer delivers a faulty product to a carry-in repair centre at any time during business hours on Monday, the product will be available for collection by the end of business day on the following Monday.
Mail-in Five, IT Support, Hardware , Business Day:
Ground Wire aims to ensure that the product will be operational and returned to the end user within five business days following arrival of the faulty equipment at a Ground Wire Service Centre for repair.
For example: Customer delivers a faulty product to a Mail-in centre at any time during business hours on Monday, the product will be returned to the customer by the end of business day on Tuesday of the following week.
Pick Up & Return, IT Support, Hardware , Two Business Day:Pick Up & Return, IT Support, Hardware , Five Business Day:
Ground Wire aims to ensure that the product will be operational and returned to the end user within two business days following the pick up of the faulty equipment from the customer.
For example: Ground Wire or an Ground Wire Service Provider pick up the defective unit from the customer any time during business hours on Monday, the product will be delivered back to the customer by the end of business day on Wednesday.
Ground Wire aims to ensure that the product will be operational and returned to the end user within five business days following the pick up of the faulty equipment from the customer..
For example: Ground Wire or an Ground Wire Service Provider pick up the defective unit from the customer any time during business hours on Monday, the product will be delivered back to the customer by the end of business day on Friday.
Ground Wire computers also offers extended/upgraded services under the name of Managed Services . A wide range of Managed services is available to cover most current Managed Service and products. It is the customerâ‚¬â„˘s responsibility to register each Manage Service, Ground Wire computers so that the related hardware is automatically allocated the correct extended/upgraded service by our management system.
All service and Warranty Will be assigned on the Invoices and your Support Plan purchased from us , Our system will alert you 90 Day prior to the expiration of the managed Service Plans and IT Support
assigned to you business .
Domain Name Registration
As consideration for the services you have selected, you agree to pay us the applicable service(s) fees. All fees payable hereunder are non-refundable unless we provide otherwise. As further consideration for the Services, you agree to: (1) provide certain current, complete and accurate information about you as required by the registration process and (2) maintain and update this information as needed to keep it current, complete and accurate. All such information shall be referred to as account information (account Information).
The fee for all domain registrations we offer is variable and dependent on the TLD chosen. The price for domain registration and renewals is displayed during the registration and renewal process. One .com, .net, .org, or .info domain registration is included free with every hosting plan. Should this price ever increase, you will be notified at least 30 days prior via the e-mailed Ground Wire Computers t Monthly Newsletter.
You hereby grant us the right to disclose to third parties such Account Information. The Registrant, by completing and submitting the Domain Name Registration Agreement (registration Agreementť), represents that the statements in its application are true and that the registration of the selected Domain Name, so far as the Registrant is aware, does not interfere with or infringe upon the rights of any third party. The Registrant also represents that the Domain Name is not being registered for any unlawful purpose. Willful provision of inaccurate or unreliable Account Information, willful failure to promptly update Account Information provided to Ground Wire Computers upon its change, or failure to respond for over fifteen (15) calendar days to inquiries by Ground Wire Computers concerning the accuracy of Account Information is a basis for cancellation of the registration.

Free Domain name comes with the terms to complete the required period of 3 years to sustain the Hosting Plan, early termination, Ground Wire computers Reserves the right to Hold your domain until payment is its cleared . Early termination fee applies for hosting and early termination. Domain Becomes a property of Ground wire computers and goes to escrow service for resale on the domain name market.
Ground Wire Computers Hosting Terms are from , 12 , 24 , 36 Months
Plans , Ground Wire computers may cancel your hosting plan for any reason. Ground Wire computers does not disable your websites or e-mails on a none paid hosting accounts , unless and until the domain name as been expired and has not been registered. upon 3 notices of none payment Ground wire computer will disable all the services associated with your hosting or domain name management, we reserve the right to place a non payment banner or we will not place them if a payment or account dispute has been filed with us .
You agree Ground Wire Computers may immediately terminate any Account which it believes, in its sole and absolute discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk e-mail. In addition, if actual damages cannot be reasonably calculated then you agree to pay Ground Wire Computer liquidated damages in the amount of $1.00 for each piece of spam or unsolicited bulk e-mail transmitted from or otherwise connected with your Account.
DISCLAIMER OF OTHER WARRANTIES
YOU UNDERSTAND AND AGREE THAT EXCEPT AS EXPRESSLY SET FORTH ABOVE, THE SERVICES (INCLUDING, WITHOUT LIMITATION, ALL ADVICE, CONTENT, AND SOFTWARE) ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, COMPLETENESS, USEFULNESS OF THE SERVICES, AND ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. GROUND WIRE COMPUTERS DOES NOT WARRANT THAT THE SERVICES WILL BE TIMELY, SECURE, UNINTERRUPTED, ERROR FREE, OR SUCCESSFUL IN RESOLVING YOUR QUESTION OR TECHNOLOGY PROBLEM. GROUND WIRE COMPUTERS MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS. NO ADVICE, RESULTS, CONTENT OR MATERIALS WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICES SHALL CREATE ANY WARRANTY. ANY CONTENT OR SOFTWARE THAT YOU ACCESS, DOWNLOAD OR USE WITH THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU AGREE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS FROM SUCH ACTIVITIES.
SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
LIMITATION OF LIABILITY
IN NO EVENT SHALL GROUND WIRE COMPUTERS, ITS SUPPLIERS, AND REFERRAL PARTNERS OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR CONTENT OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND OR NATURE, WHETHER FROM CONTRAC OR TORT (INCLUDING NEGLIGENCE), MISPRESENTATION, STRICT LIABILITY OR ANY OTHER LEGAL OR EQUITABLE THEORY, ARISING FROM DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SERVICES, SOFTWARE, CONTENT OR YOUR DEVICE AND OTHER TECHNOLOGY INCLUDING, WITHOUT LIMITATION, LOST SALES, LOST REVENUE, LOST PROFITS OR OTHER LOSS OF BUSINESS, LOSS OF OR DAMAGE TO DATA, OR COST OF SUBSTITUTE SERVICES EVEN IF GROUND WIRE COMPUTERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
IN NO EVENT SHALL THE TOTAL LIABILITY OF GROUND WIRE COMPUTERS, ITS SUPPLIERS, AND REFERRAL PARTNERS TO YOU IN THE AGGREGATE FOR ANY AND ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) ARISING FROM THE TERMS OR YOUR USE OF THE SERVICES, SOFTWARE OR CONTENT EXCEED THE GREATER OF THE AMOUNT PAID FOR THE SERVICES AT ISSUE OR $100.00 FJD.
DISPUTE RESOLUTION AND ARBITRATION ACT
Definitions. As used in this Arbitration Act, "Claims" means all claims, disputes, or controversies between You and Us of any nature or kind, whether pre-existing, present, or future, that arise from or relate to the Services. This includes but is not limited to disagreements about the validity, enforceability, or scope of this Arbitration ACT (CAP.38).
Informal Efforts to Resolve Dispute. If a dispute arises between You and Ground Wire computers , You should first attempt to resolve it by contacting Our Director at +679 775 5911 or by sending the details of Your complaint, including Your contact information for a response, to the address or fax number listed below. We will attempt in good faith to resolve all Claims submitted this way within thirty (30) days of receipt and IT support service .
We also participate in informal dispute resolution services offered by the Consumer Council Of Fiji . We have made a commitment to follow the Commerce Commission Fiji and Consumers Council Fiji's , Code of Business Practices.
Agreement to Arbitrate; Right to Opt Out. If informal efforts to resolve Claims fail or are not used, You agree that any and all Claims will be resolved exclusively by binding arbitration as described herein, except that: (i) You may assert Claims in a small claims court in the Fiji Islands if Your Claims meet the court's jurisdictional requirements; and (ii) either party may pursue Claims and relief in a court of competent jurisdiction regarding the validity and/or infringement of a party's intellectual property rights.
Arbitration ACT Fiji (CAP.38) :
1. If no other mode of reference is provided, the reference shall be to a single arbitrator.
2. If the reference is to two arbitrators, the two arbitrators may appoint an umpire at any time within the period during which they have power to make an award.
3. The arbitrators shall make their award in writing within three months after entering on the reference, or after having been called on to act by notice in writing from any party to the submission, or on or before any later day to which the arbitrators, by any writing signed by them, may, from time to time, extend the time for making the award.
4. If the arbitrators have allowed their time or extended time to expire without making an award, or have delivered to any party to the submission or to the umpire, a notice in writing staling that they cannot agree, the umpire may forthwith enter on the reference in lieu of the arbitrators.
5. The umpire shall make his award within one month after the original or extended time appointed for making the award of the arbitrators has expired, or on or before any later day to which the umpire, by any writing signed by him, may, from time to time, extend the time for making his award.
6. The parties to the reference, and all persons claiming through them respectively, shall, subject to the provisions of any law for the time being in force, submit to be examined by the arbitrators or umpire on oath or affirmation in relation to the matters in dispute, and shall, subject as aforesaid, produce before the arbitrators or umpire all books, deeds, papers, accounts, writings and documents within their possession or power respectively which may be required or called for, and do all other things which, during the proceedings on the reference, the arbitrators or umpire may require.
7. The witnesses on the reference shall, if the arbitrators or umpire think fit, be examined on oath.
8. The award to be made by the arbitrators or umpire shall be final and binding on the parties and the persons claiming under them respectively.
9. The costs of the reference and award shall be in the discretion of the arbitrators or umpire who may direct to and by whom, and in what manner, those costs or any part thereof shall be paid, and may tax or settle the amount of costs to be so paid or any part thereof, and may award costs to be paid as between solicitor and client.
